Republic Act (RA) 10022

Republic Act No. 10022 is the “Migrant Workers and Overseas Filipinos Act of 1995” as amended, and was enacted to strengthen the protection and welfare of Overseas Filipino Workers (OFWs).

It was signed into law on March 8, 2010, and is an amendment to RA 8042, the original Migrant Workers Act of 1995.

🧾 Key Features of RA 10022:

  1. ✅ Stronger Protection for OFWs
    • Requires host countries to meet certain criteria (e.g., labor laws, treaties, and actual protection practices) before Filipino workers are deployed there.
    • If a country fails to meet these standards, the Philippine government may ban deployment to that country.
  2. ✅ Standard Employment Contract
    • Mandates a unified contract with clear terms, including:
      • Salary
      • Work hours
      • Benefits
      • Insurance
      • Provisions for repatriation
  3. ✅ Mandatory Insurance Coverage
    • All agency-hired OFWs must be covered by mandatory insurance at no cost to the worker.
    • This covers:
      • Accidental death
      • Natural death
      • Permanent disability
      • Repatriation (in case of death or termination)
      • Subsistence allowance in case of contract violation
      • Money claims
  4. ✅ Reintegration Program
    • The law institutionalizes reintegration services for returning OFWs, including:
      • Livelihood assistance
      • Skills training
      • Financial literacy programs
  5. ✅ Penalties for Illegal Recruitment
    • RA 10022 strengthens penalties against illegal recruiters, including harsher fines and imprisonment.
    • Recruitment agencies may face suspension or revocation if found violating the law.
  6. ✅ Legal Assistance Fund
    • Ensures availability of funds to assist OFWs in distress, including legal representation and repatriation.

📌 Purpose of RA 10022:

To ensure that migrant workers are not only deployed to safe and just environments but also given legal, financial, and social protections before, during, and after deployment.
